Explaining Fair Use and Copyright

When we are discussing Machine Learning, we have to take into account the legal implications. Since it is new, there are numerous issues when it comes to copyright infringement. It was stated in the About Page, that the use of machine learning tools such as OpenAI ChatGPT compiles the data it has access to, meaning the Internet, and comes to an average answer. This is a large issue due to the fact that part of the data it collects may be somebody else's intellectual property, and they might not have knowledge of it being taken.

Copyright.gov writes that in order to use somebody else's work, there is permission required. (Copyright.gov). The idea is that it is somebody else's original work, and therefore, when you wish to use it in any way, you must follow the rules of Fair Use. The website states that, "Under the fair use doctrine of the U.S. copyright statute, it is permissible to use limited portions of a work including quotes, for purposes such as commentary, criticism, news reporting, and scholarly reports," (Copyright.gov). This means that only when properly citing and giving credit, only for that array of uses, can a person use another's intellectual property and that action being acceptable.
